WELCOME TO THE EBUNTI SITE – DRP Cloud México SAPI de CV and/or its affiliates (“Ebunti”) provide the Ebunti Site subject to the following terms of use (“Site Terms”). By visiting the Ebunti site, you agree to the Site Terms. Please read them carefully. Additionally, when you use any current or future service, content, or other materials from Ebunti, you will also be subject to the Ebunti Customer Agreement or other agreements that govern the use of our services (the “Agreement”).

ELECTRONIC COMMUNICATIONS
When you visit the Ebunti Site or send us emails, you are communicating with us electronically. You consent to receive our communications electronically. We will communicate with you by email or by posting notices on the Ebunti site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT
All content included on the Ebunti Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Ebunti or its content providers and is protected by Mexico’s copyright laws. The compilation of all content on the Ebunti Site is the exclusive property of Ebunti and is protected by Mexico’s copyright laws. All software used on the Ebunti site is the property of Ebunti or its software providers and is protected by Mexico and international copyright laws.

LICENSE AND SITE ACCESS
Ebunti grants you a limited license to access and make personal use of the Ebunti Site, and not to download (other than page caching) or modify it, or any part of it, except with the express written consent of Ebunti. This license does not include any resale or commercial use of the Ebunti Site or its content; any derivative use of the Ebunti site or its content; any download or copy of account information; or any use of data mining, robots, or similar data gathering and extraction tools. Unless Ebunti specifies otherwise in a separate license, your right to use any software, data, documentation, or other material accessed or downloaded through the Ebunti Site is subject to these Site Terms or, if you have an Ebunti account, to the Agreement.

The Ebunti Site or any part of the Ebunti Site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Ebunti. You may not frame or use framing techniques to include any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Ebunti without express written consent. You may not use any meta tags or other “hidden text” that uses the name or trademarks of Ebunti without express written consent. Any unauthorized use terminates the permission or license granted by Ebunti. You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the homepage of the Ebunti site, provided the link does not portray Ebunti, its products, or services falsely, misleadingly, disparagingly, or otherwise offensively. You may not use any Ebunti logo or other proprietary graphic or trademark as part of the link without express written permission.

YOUR ACCOUNT
If you use the Ebunti site, you are responsible for maintaining the confidentiality of your Ebunti account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Ebunti reserves the right to refuse service, cancel accounts, or remove or edit content at its sole discretion.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
Visitors may post reviews, comments, and other content; and send suggestions, ideas, comments, questions, or other information, provided that the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringes intellectual property rights, or otherwise harmful to third parties or objectionable, and does not consist of or contain software viruses, political campaigns, commercial solicitations, chain letters, mass emails, or any form of “spam.” You may not use a false email address, impersonate any person or entity, or mislead others as to the origin of any card or other content. Ebunti reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you post content or submit material, unless we indicate otherwise, you grant Ebunti a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, and create derivative works from, distribute, and display such content worldwide in any medium. You grant Ebunti and its sublicensees the right to use the name you submit in connection with such content, if they wish.

You or third parties may be allowed to upload certain software (including machine images), data, text, audio, video, images, or other content (“Third-Party Content”) to areas of the Ebunti community site. You acknowledge that (a) Ebunti has not tested or reviewed Third-Party Content, (b) you use any Third-Party Content at your own risk, and (c) the Third-Party Content may be subject to separate license terms as determined by the content publisher.

You represent and warrant that you own or control all rights to the content, including Third-Party Content, that you post; that the content is accurate; that the use of the content you provide does not violate this policy and will not cause harm to any person or entity; and that you will indemnify Ebunti for any claims arising from the content you provide. Ebunti has the right, but not the obligation, to monitor and edit or remove any activity or content. Ebunti does not assume any responsibility and is not liable for any content posted by you or a third party.

Ebunti respects the intellectual property of third parties. If you believe your work has been copied in a way that constitutes copyright infringement, please follow our Notice and Procedure for filing copyright infringement claims.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THE EBUNTI SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING ANY SOFTWARE), AND SERVICES INCLUDED OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY EBUNTI “AS IS” AND “AS AVAILABLE,” UNLESS OTHERWISE SPECIFIED IN THE AGREEMENT. EBUNTI MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING ANY SOFTWARE), OR SERVICES INCLUDED OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE EBUNTI SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT USE OF THIS SITE IS AT YOUR OWN RISK. TO THE EXTENT PERMITTED BY APPLICABLE LAW, EBUNTI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EBUNTI DOES NOT WARRANT THAT THIS SITE; INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING ANY SOFTWARE) OR SERVICES INCLUDED OR MADE AVAILABLE THROUGH THE EBUNTI SITE; ITS SERVERS; OR EMAILS SENT FROM EBUNTI ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. APPLICABLE LAW
By visiting the Ebunti site, you agree that the laws of the state of Jalisco, Mexico, without regard to conflict of law principles, will govern these Terms of the Site and any dispute of any kind that may arise between you and Ebunti.

DISPUTES
Any dispute related in any way to your visit to the Ebunti site or to the services provided by Ebunti or through the Ebunti site, in which the total claimed repair request on behalf of one or more parties, will be resolved in any state or federal court in Guadalajara, Jalisco, Mexico. You consent to the exclusive jurisdiction and venue of such courts.

SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies on the Ebunti site. These policies also govern your visit to the Ebunti site. We reserve the right to make changes to the Ebunti site, policies, and these terms of the site at any time. If any of these conditions are found to be invalid, void, or unenforceable for any reason, such condition will be considered severable and will not affect the validity and enforceability of any remaining conditions.

NOTICE AND PROCEDURE FOR COPYRIGHT INFRINGEMENT CLAIMS

If you believe that your work has been copied in a way that constitutes copyright infringement, provide our copyright agent with the written information specified below. Please note that this procedure is solely for notifying Ebunti that your copyrighted material has been infringed.
An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
A description of the copyrighted work that you claim has been infringed;
A description of where the material you claim infringes is located on the Site;
Your address, phone number, and email address;
A statement that you believe in good faith that the disputed use is not authorized by the copyright owner, its agent, or the law;
